Terms & Conditions

We thank you for choosing to book with Elm Tree Farm, Lea and look forward to welcoming you and doing all we can to make your stay thoroughly enjoyable.

When you make this booking, you are entering into a formal contract under English law with us, the Trustees of the D K Lucking Trust, owners of Elm Tree Farm, Lea, Matlock, Derbyshire DE4 5GR. We undertake to provide you with the holiday dates and prices, as agreed between us, and you undertake to pay us in full for the holiday you are booking. You are also agreeing to the following Terms & Conditions on behalf of all those people who will occupy the property during your holiday period. We ask that you ensure they are all aware of these booking conditions.

BOOKING: You may book personally over the telephone with us or online on our website. When you submit a provisional booking via our online reservation system, you will receive an automatically generated booking summary by email. This does not form a contract between us. A contract will only arise after the deposit has been received by us and the booking confirmed in writing with a formal letter of confirmation sent to you by email or post.

DEPOSIT: For all bookings we require a non-refundable deposit of 30% to confirm the booking. This may be made by cheque, internet bank transfer or credit/debit card payments made through Paypal (for which you do not need a Paypal account, or can by-pass an existing Paypal account if you have lost your username and/or password). You must ensure that the deposit reaches us within 7 days of making the provisional booking or we may be obliged to release the dates. For holidays that are to take place within eight weeks (56 days) of making the booking, the full balance is due within seven days and, in all cases, before your arrival.

FINAL PAYMENT: This is due eight weeks (56 days) before the start of your holiday. We would be grateful if payment could be made by cheque or internet bank transfer for which our bank details will be supplied.

CANCELLATION: If, for whatever reason, you cannot take the holiday you have booked, you are still liable to pay for the booking in full, even if we have not yet received your balance.

However, we would attempt to re-let the dates and, if we succeed, we would not demand payment of the balance due. But if we are unable to re-let the dates, you are still responsible for the full payment. To mitigate this difficult situation, we strongly recommend that you take out cancellation insurance, which is inexpensive and can be obtained from an insurance broker directly or via the internet.

ALL-INCLUSIVE PRICE: The price we charge is fully inclusive of electricity, under floor central heating, hot water, towels, bed linen, duvets, tea-towels and useful household supplies as stated on our website.

ARRIVAL & DEPARTURE: Elm Tree Farm, Lea will be ready for you from 4pm on the day of arrival. We ask that you let us know your approximate time of arrival a few days beforehand to make arrangements regarding the keys. Contact details will be provided about 2 weeks beforehand.

We ask you, please, to leave by 10am on the day of departure. We ask that you leave Elm Tree Farm, as far as possible, in a clean and tidy condition. The property is hired on the understanding that the accommodation is for holiday use only and no right to remain in the accommodation exists for the guest or anyone in the guest party.

DAMAGE & BREAKAGES: Please look after our property and supervise closely children and pets. Under no circumstances may pets be left unattended at or inside the property. You are responsible and liable for any breakages or damage that you cause to the buildings or their contents. Please report any problems as soon as they occur. We do not normally charge for what we consider to be minor breakages. Should damage or breakages occur that are, in our estimation, significant, we reserve the right to charge you for repair, replacement or making good the damage.

PARTIES: You are welcome to hold family parties provided that you show consideration for  the occupants of the adjacent cottages. We do not permit the use of amplified speakers nor the playing of loud music after 11pm. Additional party guests are not permitted unless agreed with us beforehand.

SMOKING: Smoking is not permitted anywhere inside the house, open barn or within the central courtyard at Elm Tree Farm. In fairness to our other guests we ask that any cigarette butts are not placed in any of the bins within the cottage and are placed in the main bin outside or are taken home.

THE SHIPPON: The northern enclosed section of the smaller barn opposite the main building, which we call the Shippon, is used by our family as a base from which to maintain the property and its associated farmland. As such  it may sometimes be occupied during your stay, thus enabling us to assist you immediately should any problems arise. You will also receive contact details of our Housekeepers who live close by.

LIABILITY: We do not accept liability for loss, damage or injury to any member of your party or any vehicles or possessions. We cannot be held responsible for the activity of any wildlife or livestock that may live in the vicinity of Elm Tree Farm.

We (or our representative) reserve the right to enter the property at a reasonable time of day for the purpose of emergency maintenance or repair or any other need.

NON-AVAILABILITY OF ACCOMMODATION: We would only cancel your holiday if your accommodation were unavailable for reasons beyond our control, such as unsafe access due to very severe weather. We would then refund all monies paid by you for the holiday. Our liability would not extend beyond this refund.

DATA PRIVACY:  We treat any data collected during the course of making bookings or dealing with enquiries in strict confidence. This data is kept on our home computer and on the secure servers of Supercontrol online booking system. We will not pass it on to any third party without your full knowledge and permission.

COMPLAINTS: We want you to enjoy your stay at Elm Tree Farm, Lea. Should you have any cause for dissatisfaction or complaint, please advise Hilary or another member of the management team immediately, and before your departure. We will do our best to resolve the issue to your satisfaction.
